It would be safe to say that James Iha and D'Arcy are no longer big Smashing Pumpkins fans.
The two former members of the group filed suit against Virgin Records yesterday for not paying them for digital downloads of Pumpkins music. The suit alleges the Virgin entered a deal with Billy Corgin in 2000, five years after the group broke up, and began licensing the band's music.
"To date, Virgin continues to engage in the exploitation of electronic transmissions of the band's recordings without the plaintiffs' consent," the lawsuit states.
Corgin, as well all know, revived the band last year without Iha and D'Arcy, though we'd argue the success of that endeavor.
Incidentally, tickets go on sale tomorrow for the Smashing Pumpkins show at Raleigh's Memorial Auditorium on Aug. 17.
